Disclaimer for Customer Install
WARRANTY DISCLAIMER: The Customer acknowledges and agrees that the products sold by the Company hereunder are sold “as-is” without any warranty, express or implied.
Customer Responsibilities; Waiver and Release; Indemnification: Customer acknowledges and accepts full responsibility for (1) ensuring that its chosen light display is up to all codes and regulations applicable to the installation location; (2) ensuring that sufficient power and outlets exist at its chosen installation location for its chosen light display; (3) installation of its chosen light display. Customer waives and releases the Company, and further agrees to indemnify the Company and hold the Company harmless, from any and all claims and damages, whether tangible or intangible, foreseen or unforeseen, to the Customer, the Company, any third party, or its/their property arising in any way from the foregoing.
LIMITATION ON DAMAGES: IN NO EVENT SHALL THE COMPANY BE LIABLE FOR DAMAGES TO THE CUSTOMER OR ANY THIRD PARTY IN EXCESS OF THE AMOUNT PAID BY THE CUSTOMER TO THE COMPANY FOR THE PRODUCT.
Forum Selection; Choice of Law: All disputes concerning the Product purchased by the Customer from the Company or the transactions between the Customer and the Company shall be governed by the laws of the State of Idaho and shall be litigated in the State or Federal Courts of the State of Idaho, County of Twin Falls.
